Compulsory Enforcement Service clarifies  2017-02-17 18:17

   In relation to the article posted in "Aravot" daily newspaper on February 16, 2017 with the title "Used baby shoes and clothing in the JACES auction", the Judicial Acts Compulsory Enforcement Service of the Republic of Armenia informs that the writ of execution No. EKD‑3879/02/15 was given on 25.01.2016, by which the 1488 pairs of children's shoes in “Alliance Terminal” LLC customs warehouse had been recognized as an ownerless property and had been surrendered to the state. At the same time, by another writ of execution No. EKD-4966/02/15 given on 19.01.2016, the used clothes and shoes of 734 kg had also been recognized as an ownerless property and had been surrendered to the state.
  
According to the regulation defined by the decision of the Government of the Republic of Armenia N 146-N of 18 February, 2010, the properties of the mentioned category are handed over to the Judicial Acts Compulsory Enforcement Service of the Ministry of Justice of RA in order to sell in accordance with the Law of RA “On Public Auctions”.
  
Regarding the low price of grasslands and arable lands, mentioned in the same publication, the Compulsory Enforcement Service informs that in accordance with the 2nd Part of the Article 35.4 of the Law of RA “On Public Auctions”, if the auction is suspended due to absence of buyers or because bids were not made, during the second auction the starting price of the lot shall be reduced by 10 percent from the first auction starting price. Therefore, the so-called “water price for the land” is solely due to the fact of not having any buyer in the forced electronic auction.
  
In relation to the realization of the medical centre's property in the forced electronic auction, mentioned in the same publication, the Compulsory Enforcement Service informs that it is a joint ownership of individuals and does not belong to the medical centre.
 
The Compulsory Enforcement Service once again urges mass media to rely solely on verified and well-grounded information while doing publications and making conclusions relating to the activities of the Service.
